Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: The period within which the consumer can exercise their right of withdrawal.

  • Consumer: The natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with The Galleria.

  • Day: Calendar day.

  • Durable data carrier: Any medium that enables the consumer or The Galleria to store information addressed personally to them for future reference and unaltered reproduction.

  • Right of withdrawal: The consumer’s right to withdraw from the distance contract within the cooling-off period.

  • Entrepreneur: The Galleria, the natural or legal person offering products to consumers at a distance.

  • Distance contract: A contract concluded between The Galleria and the consumer using distance communication techniques exclusively.

Article 2 - Applicability

These general terms and conditions apply to every offer made by The Galleria and every distance contract and order concluded between The Galleria and the consumer.

By placing an order, the consumer agrees to these terms and conditions. The text of these general terms and conditions is made available electronically in such a way that it can be stored on a durable medium.

Article 3 - The Offer

  • If an offer is subject to conditions, these will be explicitly stated.

  • The offer includes a complete and accurate description of the products.

  • Images are for illustrative purposes only; actual product colors may vary slightly.

  • Prices are exclusive of customs clearance fees and import VAT. These additional costs are the sole responsibility of the customer.

Article 4 - The Agreement

  • The contract is concluded when the consumer accepts the offer and meets the conditions set therein.

  • If the consumer accepts the offer electronically, The Galleria will confirm receipt of acceptance without delay.

  • The Galleria reserves the right to refuse orders in cases of suspected fraud or non-compliance with payment obligations.

Article 5 - Right of Withdrawal

  • Consumers have 14 days after receiving the product to withdraw from the contract without giving reasons.

  • During this period, the consumer must handle the product and packaging with care.

  • If the consumer exercises the right of withdrawal, they must return the product in its original condition and packaging at their own expense to the designated return address in China.

Article 6 - Return Costs and Procedure

  • If the consumer exercises the right of withdrawal, they bear all costs of returning the product to China.

  • The Galleria is not responsible for lost or damaged returns.

  • Refunds will be processed within 14 days after receipt and inspection of the returned product.

Article 7 - Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made or personalized products.

  • Products that cannot be returned due to hygiene reasons if unsealed.

  • Items that deteriorate quickly or have a short shelf life.

Article 8 - Pricing and Payments

  • Prices are fixed during the validity of the offer, except in cases of VAT or currency fluctuations.

  • Payments must be completed before the order is processed.

  • The Galleria reserves the right to cancel orders in case of non-payment.

Article 9 - Shipping and Delivery

  • All products are shipped directly from China.

  • Standard delivery times vary but typically range between 10-30 business days.

  • The Galleria is not responsible for customs delays or import duties.

Article 10 - Complaints and Dispute Resolution

  • Complaints should be submitted in writing within 7 days of receiving the product.

  • The Galleria will respond within 14 days.

  • If no resolution is found, disputes will be governed by Hong Kong law.

Article 11 - Liability

  • The Galleria is not responsible for indirect damages resulting from product use.

  • The consumer assumes responsibility for compliance with import regulations in their country.

Article 12 - Governing Law

All agreements with The Galleria are governed exclusively by Hong Kong law, even if the consumer resides abroad.
